Privacy Policy

The policies below are applicable to ProcessMAP Corporation’s (ProcessMAP’s) corporate website http://processmap.com on the World Wide Web owned, operated, or managed by ProcessMAP. ProcessMAP may update this Privacy Policy from time to time, in which event, we will post an updated policy on ProcessMAP corporate website, and will notify all our current customers at least 30 days prior to any change being implemented.

Accordingly, ProcessMAP adheres to strict standards in connection with the collection, use and disclosure of personal information, consistent with the laws of the countries in which ProcessMAP conducts business. ProcessMAP Safe Harbor Privacy Policy (the “Policy”) sets forth the privacy principles that ProcessMAP follows with respect to personal information transferred from the European Economic Area (EEA) (which includes the twenty-seven member states of the European Union (EU) plus Iceland, Liechtenstein and Norway) to the United States, please contact us to obtain a copy of our E.U. Safe Harbor Privacy Policy.

ProcessMAP Corporation complies with the EU-U.S. Privacy Shield Framework and the Swiss – U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively.  ProcessMAP Corporation has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.

Recourse, Enforcement and Liability

In compliance with the Privacy Shield Principles, ProcessMAP Corporation commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact ProcessMAP Corporation at:

We will investigate your complaint, take appropriate action and report back to you within 45 days.

If the Personal Information in question was transferred from the EU to the United States, and you are not satisfied with our response, have further committed to refer unresolved Privacy Shield complaints to the American Arbitration Association (AAA)’s Independent Conflict Dispute Resolution ICDR/AAA Program, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgement of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit http://go.adr.org/privacyshield.html for more information or to file a complaint.

Additionally, with respect to complaints concerning human resources data that is transferred from the EU to the United States, we have agreed to participate in the dispute resolution procedures of the EU Data Protection Authorities. ProcessMAP Corporation will cooperate with the appropriate EU Data Protection Authorities during investigation and resolution of complaints concerning human resources data that is transferred from the EU to the United States brought under Privacy Shield.

These recourse mechanisms are available at no cost to you. Damages may be awarded in accordance with applicable law.

Under certain conditions, if you are not satisfied with the above recourse mechanism, you may be able to invoke binding arbitration.

With respect to personal information processed on behalf of our EEA and Swiss business customers, under EU privacy laws, personal information of consumers may be transferred by ProcessMAP Corporation under our Privacy Shield certification or Standard Contractual Clauses, as described above.

Additional descriptions about how we treat personal information that is transferred in reliance on Privacy Shield are available in the following sections of the ProcessMAP Corporation Privacy Policy:

A. Third parties to which ProcessMAP Corporation discloses personal information, and the purposes for which it does so.
– ProcessMAP Corporation never disclose Personal Information to any third party without customer approval.

B. The right of individuals to access their personal data.
– Customer has full rights to access their individual/user personal data.

C. The choices and means your organization offers individuals for limiting the use and disclosure of their personal data.

D. Your organization being subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).
– ProcessMAP Corporation is subject to the investigatory and enforcement powers of the FTC

E. The possibility, under certain conditions, for the individual to invoke binding arbitration.
– If we do not resolve your complaint, ProcessMAP Corporation has chosen to cooperate with a panel established by the EU Data Protection Authorities, or the Swiss Federal Data Protection and Information Commissioner, as applicable, who will hear such complaints.

F. The requirement for your organization to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
– ProcessMAP may share your personal information:
-> When you agreed to the sharing
-> When we are required to provide information in response to a subpoena, court order, or other applicable law or legal process
-> When we have a good faith belief that the disclosure is necessary to prevent or respond to fraud, defend our apps or websites against attacks, or protect the property and safety of ProcessMAP Corporation, our customers and users, or the public
-> If we merge with or are acquired by another company, sell an ProcessMAP website, app, or business unit, or if all or a substantial portion of our assets are acquired by another company. In those cases, your information will likely be one of the assets that is transferred

G. Your organization’s liability in cases of onward transfers to third parties
– In case of any transfer of personal data to a third party acting as a controller, ProcessMAP Corporation will enter into a contract with the third-party controller that says data may only be processed for limited and specified purposes consistent with the consent provided by the individual, and that the recipient will provide the same level of protection as the Principles and will transfer such data only for limited and specified purposes and take appropriate steps to ensure that the agent effectively processes the personal information transferred in a manner consistent with the organization’s obligations under the Principles. Upon notice, ProcessMAP Corporation take reasonable and appropriate steps to stop and remediate unauthorized processing and will provide a summary or a representative copy of the relevant privacy provisions of its contract with that agent to the department upon request.

I. General
ProcessMAP respects the privacy of every individual who visits Web Sites, sends us e-mail, uses our applications on a hosted environment, or utilizes our support portal (actions collectively called “Web Site Visits”). This Privacy Policy outlines the information ProcessMAP will collect and how we will use that information. This Statement will also instruct you on what to do if you do not want your personal information collected or shared when you visit Web Sites.

II. Personal Information
ProcessMAP will not collect any personally identifiable information about you (that is, your name, address, telephone number, or email address) unless you provide it to us voluntarily. The following are some examples of when ProcessMAP may require that you provide personally identifiable information: (1) To complete an online form for a product or service surveys (if you do not wish to complete an online form, we will always provide an option for you to complete an order by calling a phone number); (2) To request more information about new or current ProcessMAP products or services. We use the information to contact customers to further discuss customer interest in our company, the Services that we provide, and to send information regarding our company or partners, such as promotions and events.

Customers of ProcessMAP hosted software services will be using ProcessMAP-provided infrastructure to host data and information. ProcessMAP will not review, share, distribute, print, or reference any such data and information unless (1) approved by Customers; (2) except as provided in the ProcessMAP Terms of Use; (3) or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, fix a bug, provide user support, suspected violation of the Terms of Use, or as may be required by law. Of course, customers are responsible for maintaining the confidentiality and security of their user registration and password.

ProcessMAP will not share personally identifiable information to third parties, unless stated at the time of collection.

III. Use of Cookies
When you view one of our Web Sites or advertisements, we may store some information on your computer. This information will be in the form of a “Cookie” or similar file and will be used to determine ways to improve our Web sites, advertisements, products or services. For example, Cookies allow us to tailor a Web site to better match your interests and preferences. With most Internet Browsers, you can erase Cookies from your computer hard drive, block all Cookies, or receive a warning before a Cookie is stored. Please refer to your Browser instructions or help screen to learn more about these functions.

IV. Security of your personal data
ProcessMAP has implemented appropriate technical and organizational security measures to prevent (1) unauthorized or unlawful disclosure or access to personal data; (2) accidental or unlawful loss, destruction, alteration, or unauthorized disclosure of your personal data; and (3) accidental damage to your personal data. These measures ensure an appropriate level of security in relation to the risks inherent in the processing and the nature of the personal data to be protected. Your securely held personal data will only be accessible by select authorized members of staff within ProcessMAP and its business partners.

V. Security
All hosted software sites (Customer Sites) maintained by ProcessMAP has security measures in place to help protect against the loss, misuse, and alteration of the data and information under our control. When Customer Sites are accessed using Microsoft Internet Explorer versions 5.0 or higher, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure that data and information is safe, secure, and available only to you. ProcessMAP also implements an advanced security method based on dynamic data and encoded session identifications, and hosts the website in a secure server environment that uses a firewall and other advanced technology to prevent interference or access from outside intruders. Finally, ProcessMAP provides unique user names and passwords that must be entered each time a customer logs on. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.

VI. Who to Contact
If you have submitted personally identifiable information through Web Sites or interactive advertisement, and would like that information deleted from our records, please contact us at our email address, info@processmap.com, and we will use reasonable efforts to delete this information from our existing files.

Right to Change Policy

In general, changes will be made to this Policy to address new or modified laws, changes to EU-US Privacy Shield, changes to EU-US Swiss Safe Harbor, or new or modified business procedures. However, we reserve the right to amend this Policy at any time. Appropriate notice will be given concerning such amendments.
